1. Acceptance of Terms
By accessing or using Local Mapr ("the Service"), operated at localmapr.projectoutcast.com, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service.
2. Service Description
Local Mapr is a free, browser-based tool that allows users to extract publicly available business data from Google Maps using the Google Places API. The Service enables users to:
- Search for businesses by location and category
- View results on an interactive map
- Download extracted data in CSV and Excel formats
The Service requires users to provide their own Google Places API key. Local Mapr does not provide API keys or Google Cloud accounts.
3. Your Google API Key and Google Cloud Account
By using Local Mapr, you acknowledge and agree that:
- You are solely responsible for obtaining and maintaining a valid Google Cloud account and Google Places API key
- All Google Places API usage costs are billed directly to your Google Cloud account. Local Mapr has no involvement in, and no responsibility for, any charges incurred on your Google Cloud account
- You are solely responsible for securing your API key, including setting appropriate API restrictions in your Google Cloud Console
- You must comply with the Google Maps Platform Terms of Service at all times
- Local Mapr is not responsible for any consequences arising from your use of the Google Places API, including but not limited to account suspension, billing charges, or terms of service violations
4. Acceptable Use
You agree to use Local Mapr only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Service for any purpose that violates any applicable local, national, or international law or regulation
- Use scraped data for unsolicited communications (spam), harassment, stalking, or any form of abuse
- Collect or process personal data in violation of the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), or any other applicable privacy legislation
- Use the Service to infringe upon the intellectual property rights of any third party
- Attempt to circumvent rate limits, security measures, or access controls of the Service or Google's APIs
- Use automated tools (bots, scripts) to access the Service beyond its intended use
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
- Redistribute, resell, or sublicense the Service itself
- Introduce malware, viruses, or any other harmful code through the Service
5. Third-Party Services and Data Ownership
No affiliation with Google: Local Mapr is not affiliated with, endorsed by, or sponsored by Google LLC or Alphabet Inc. "Google Maps," "Google Places," and related trademarks are the property of Google LLC.
Data ownership: All business data retrieved through Local Mapr originates from Google Maps and is subject to Google's terms of service and the rights of the respective business owners. Local Mapr does not claim ownership of any data extracted through the Service.
Your responsibility: You are solely responsible for ensuring that your collection, storage, and use of scraped data complies with all applicable laws, including privacy regulations, data protection laws, and third-party terms of service.
Public data: The Service facilitates access to publicly available business information listed on Google Maps. It does not bypass any authentication, login requirements, or access controls.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE
- That the Service will be uninterrupted, timely, secure, or error-free
- That the results obtained from using the Service will be accurate, reliable, or complete
- That the Service will meet your specific requirements
- That any errors in the Service will be corrected
We do not guarantee the accuracy, completeness, or reliability of any data extracted through the Service. Data obtained from Google Maps may be outdated, incorrect, or incomplete. You should independently verify any critical data before relying on it for business decisions.
We do not guarantee the availability of Google's APIs. Changes to Google's API, pricing, or terms of service may affect the functionality of Local Mapr at any time without notice from us.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOCAL MAPR, ITS OPERATORS, OWNERS, OR AFFILIATES BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages arising from your use of or inability to use the Service
- Damages arising from any data obtained through the Service
- Damages arising from unauthorized access to your API key or data
- Google API charges or costs incurred on your Google Cloud account
- Any actions taken by Google, including API access revocation or account suspension
Since Local Mapr is a free service, our total aggregate liability to you for all claims arising out of or relating to the use of the Service shall not exceed one hundred US dollars (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
8. Indemnification
You agree to indemnify, defend, and hold harmless Local Mapr, its operators, owners, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your use, storage, or distribution of data obtained through the Service
- Your violation of Google's Terms of Service or any other third-party terms
- Your violation of any applicable law, regulation, or third-party rights (including privacy and data protection laws)
- Any claim by a third party related to data you collected using the Service
9. Intellectual Property
The Service, including its design, code, branding, logo, and user interface, is the intellectual property of Local Mapr and is protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent.
Data you extract using the Service is subject to the intellectual property rights of Google and the respective business owners. Local Mapr makes no representations regarding your right to use such data.
10. Scraping and Legal Compliance
Local Mapr facilitates access to publicly available business information through the official Google Places API. The Service:
- Uses the official Google Places API, which is a paid Google product designed for this purpose
- Does not bypass any authentication, CAPTCHA, or access controls
- Does not violate the Computer Fraud and Abuse Act (CFAA) as it does not access any system without authorization
- Does not scrape or crawl websites directly
Your legal responsibility: Laws regarding data collection, scraping, and use of business data vary by jurisdiction. You are solely responsible for ensuring your use of the Service and the data obtained through it complies with all applicable laws in your jurisdiction, including but not limited to GDPR, CCPA, CAN-SPAM, and any local data protection or privacy laws.
Local Mapr does not provide legal advice. If you are unsure about the legality of your intended use, consult a qualified legal professional.
11. Service Modifications and Discontinuation
We reserve the right to, at any time and without prior notice:
- Modify, update, or discontinue any part of the Service
- Restrict or block access to users who violate these Terms
- Implement usage limits or additional requirements
- Discontinue the Service entirely
We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
12. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet outages, power failures, third-party service disruptions (including Google API outages), cyberattacks, or pandemics.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE), without regard to conflict of law principles.
In the event of any dispute arising from or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute informally by contacting us. If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal proceedings in the courts of the UAE.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Local Mapr regarding your use of the Service. These Terms supersede any prior agreements or understandings, whether written or oral.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
For material changes, we will make reasonable efforts to provide notice (such as a banner on the website). It is your responsibility to review these Terms periodically.
